WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE THEM?
Judgment of the Grand Chamber of the Court of Justice of the European Union of 1 October 2019
The judgment of the Grand Chamber of the Court of Justice of the European Union, dated October 1, 2019, must be interpreted as meaning that consent is not validly given when the storage of information, or access to information already stored on the terminal equipment of a website user, through cookies is authorized by means of a box marked by default, which the user must uncheck if they wish to refuse their use. In this sense, authorization must be based on explicit acceptance or an equal rejection by the user.
This interpretation cannot vary depending on whether the information stored or consulted on the user’s terminal of a website consists of personal data or not.
The Grand Chamber of the Court of Justice of the European Union also stipulates in this judgment that the information that the service provider must provide to the user of an internet website must include the duration during which the cookies will remain active and the possibility of third parties accessing the information they store. This requirement is established in the version amended by Directive 2009/136, which amends Article 5(3) of Directive 2002/58/EU.
Regarding the possibility of the user rejecting the use of cookies, it should be noted that if you reject or delete the cookies used to browse the website, we will not be able to maintain your preferences, some features of the pages will not be operational, we will not be able to offer you personalized services, and each time you browse our website, we will have to request your authorization again for the use of cookies.
